This is the fourth edition of the acclaimed volume of Milde's International Air Law and ICAO, first published in 2008. It has now been fully revised by Dr. Attila Sipos, LL.M., to take the latest developments and events into account. Arbitration is still a time- and cost-efficient, professional way of resolving cross-border disputes. However, its advantages seem to vanish if one party is obstructive and tries to delay or even sabotage the proceedings. For example, a party may initiate state court proceedings in violation of the arbitration agreement, refuse to pay the advance on costs or fail to follow a document production order of the arbitral tribunal. This work first deals with the obligations that arise from an arbitration agreement. The adjective “private” in Private International Law (PIL) distinguishes PIL from its public international sibling but also confines its scope to horizontal disputes between parties other than states acting as such. Although the idea of arbitral tribunal's mandate is in everyday use in the international arbitration scholarship, it remains an elusive concept lacking any legal definition. Often associated with other notions such as the tribunal's mission, powers, authority or even jurisdiction, the meaning of arbitral tribunal's mandate remains a moving target and escapes easy classification. Yet, perhaps somewhat surprisingly, a non-compliance with the arbitral tribunal's mandate provides a basis for a challenge of the arbitral award at the post-award stage (either during setting aside proceedings or at the enforcement stage). Since the concept of the tribunal's mandate is vague, it attracts, in turn, a broad interpretation of the ground leading to a frustration of the fundamental value of arbitration - the finality of the arbitral award. It is therefore essential to determine how the national courts review arbitral awards on the basis of 'excess of mandate' and consequently in what instances they accept the argument that the tribunal acted in violation of its mandate. This study aims at recognizing the similarities and differences of the 'excess of mandate' type of challenges in selected legal systems (namely the UNCITRAL Model Law, France, England, the U.S. and the New York Convention). Looking through the eyes of what the selected legal systems consider to be an 'excess of mandate' allows to identify common features and contributes to a better understanding of the concept of the arbitral tribunal's mandate by arbitrators, judges and legal practitioners alike. Sustainable development is a globally recognized goal. However, governments are failing to reach agreement on how this should be achieved. Private actors that are under stakeholders' pressure try to fill this regulatory gap by developing various types of transnational private regulation. However, transnational private regulation suffers from weak legitimacy, questionable effectiveness, and lack of credible enforcement. This book suggests that supply chain contracting may offer an alternative regulation that could lead us away from the current regulatory impasse or at least be one of the missing pieces in the puzzle. Despite the traditionally primary goal of business - to make profit - companies are, under the imperative of corporate social responsibility ('CSR'), engaging in activities pursuing public goals in the social and environmental spheres. This book studies one of the tools developed to implement CSR into the business operations, social and environmental clauses in international supply chain contracts ('sustainability contractual clauses', SCCs). Since there is a lack of literature and regulation on this topic, companies use SCCs without proper knowledge or guidance why and how this should be done and what legal consequences this may have. This publication fills this gap by discussing the use of the legal instrument of contract to pursue social and environmental goals, analyzing the legal framework of sustainability contractual clauses, examining what legal effects SCCs may have, and evaluating the contribution of this activity in terms of achieving sustainable development objectives. The aim is to explore both the potential and the limitations of contractual governance in achieving global sustainability and thus contribute to the current discussion on the development of new regulatory and governance designs in this area.

Climate change and other forms of environmental degradation, such as earthquakes and soil erosion, in combination with other factors, such as poverty, lack of government action and armed conflict, can lead to forced migration. The protection of these environmental refugees requires a different approach than that of 'traditional war refugees'. Most environmental refugees are internally displaced. As a result, developing countries that are hit hardest by the negative effects of climate change, also have to deal with high numbers of internally displaced persons. These countries rely on international support to be able to bear the costs of mitigation and adaptation measures. The current legal system not only offers insufficient protection for environmental refugees, but also offers insufficient opportunities for support by the international community. Principles and rules of international environmental law, human rights law and State responsibility can be used in an instrumental way to co-finance and support local measures. This book examines the legal framework underlying theinternational aviation and climate change discourse. It analyzes the suitability of theInternational Civil Aviation Organization's (ICAO) institutional setting to address climatechange and provides a critical assessment of the European Union Emission Trading Scheme.Finally, the author makes several recommendations to facilitate the adoption,implementation and, ultimately, compliance with the ICAO's global market-based measurescheme to limit greenhouse gas emissions from international aviation.

It further argues that despite its constitutional and international guarantee, the right to freedom of expression has not been adequately enjoyed in Cameroon, which is partly due to the lack of well-defined legislation and effective enforcement mechanisms to ensure adequate protection for individual rights holders. In addition, it contends that states must comply with their treaty obligations under international law as a matter of constitutional and human rights doctrine. The International Criminal Court (ICC) and the United Nations Security Council (UNSC) are both empowered to request States to freeze individuals' assets. Regardless of their duration, such measures necessarily infringe upon the targets' rights. Yet, the longer assets are frozen, the more acute these infringements can become. ICC-requested asset freezes can endure from the issuance of an arrest warrant until the accused is acquitted or convicted, whereas UNSC ordered measures continue until international peace and security is restored. Asset freezes executed at the behest of the ICC and the UNSC are therefore rarely short in duration. The focus of this book rests on the two bodies' exercise of their asset freezing powers, with a particular emphasis on the legal protections available to the individuals at the receiving end of the procedures with which the ICC and the UNSC are equipped. In her inaugural lecture of 9 June 2023 Prof. Dr. Franziska Weber delved into the conundrum of sharing others' data: By sharing our personal data we also share - directly and indirectly - information about others. In some situations we are aware of this, in others less so. Weber outlines the social problems this entails with a special focus on negative data externalities. She then illustrates data valuation challenges and presents experimental insights which counter the claim that the sharing individuals are oblivious to the externality they create. She ends with some recommendations on how some fine-tuning of the current legal regime can improve incentives and outcomes on data markets by bringing them more in line with citizens' preferences. It is striking that the General Data Protection Regulation (GDPR) is tailored to individual data subjects and largely neglects the interdependent notion of data. To improve the GDPR a stronger consideration of the other needs to implemented, be it when consenting, in the context of legitimate interests or other data processing grounds. It is, furthermore, desirable to reduce the processing of allegedly anonymous data which falls outside the scope of the GDPR.
